DEPOSIT AGREEMENT

This contract is between Marybeth and/or Michael Pirrone, conducting business at Deity Bengals and Chausies Cattery, herinafter called Breeder, and

This agreement concerns the kitten/cat, hereinafter called Bengal or Chausie, described below:

On this ________ day of ____________, 20___, a deposit of $_____________ has been received from Purchaser to be applied towards the purchase price of the above described kitten/cat. The balance due must be paid by ___________________, and the above mentioned kitten/cat will not be released to the new owner until balance is paid in full. If balance is not paid in full by said date, then the non-refundable deposit will be forfeited and not refunded. The purpose of the deposit is to insure the Purchaser’s intent to purchase the above described kitten/cat. This deposit is not refundable should the Purchaser, for any reason, change his/her mind about purchasing the kitten/cat. The above said kitten/cat is being held for the Purchaser and will not be sold to any other purchaser, regardless. A breech of contract, either verbal, written, or through neglect or avoidance to communicate, on Purchaser’s part can jeopardize the chance of finding the above said kitten/cat a new home as quickly as possible. For this reason, deposits are not refundable; to insure Purchaser’s commitment to purchase above said kitten/cat. The balance due must be paid as indicated above and delivery accepted at the time. The purpose of this Deposit Agreement also serves as a guarantee for the amount of deposit. The above amount of deposit will be refunded to the Purchaser if the Seller fails to make available the above said kitten/cat to purchaser. Kittens are ready to go at ten to twelve weeks of age. Should the buyer request that the kitten be held for a period beyond 14 days after this time, a boarding charge of $7.00 per day will be accrued, unless specific arrangements to the contrary have been made between parties.

*Please note that the deposit on the F-1 Bengals is $500 to hold the kitten/cat. Should the purchaser change their mind about the purchase of the kitten/cat, the deposit will be returned after a new approved buyer is located.

Breeder’s failure to enforce any event of breech of this contract shall not constitute consent to any breech or a waiver of Breeder’s right to enforce any other breech of the contract. If any clause of this contract is invalid or illegal or unenforceable, the remainder is enforceable.

All disputes regarding this contract or the kitten/cat, will be litigated and governed under the laws and statutes of Seller’s home state and county at time of dispute.

ENTIRE AGREEMENT: This contract constitutes the entire agreement between Breeder and Purchaser pertaining to this kitten/cat. It supercedes all prior agreements and understandings, either oral or written, of the Breeder and Purchaser in connection therewith.
