Purchaser agrees to the following:
- Under no circumstances will the kitten/cat be sold, leased, or given away to any pet shop.
- The kitten/cat will be kept indoors and not allowed to roam freely outside.
- The kitten/cat is purchased as a Pet___ Breeding___ Show___.
- If purchased as a pet, Purchaser agrees to spay/neuter the kitten/cat by 6 months of age and guarantees the kitten/cat will not be used for stud/breeding.
- If purchased as a pet, Seller will provide pedigree and registration papers upon receiving veterinarians certificate of spay/neuter. If sold as a pet and altering certificate is not received by ________________________, the undersigned buyer agrees that Seller has the right to reclaim the above named kitten/cat without refund of purchase price and/or receive an additional $1000 as payment for breeding rights. Any legal fees incurred in doing so will be paid by purchaser.
- Vaccinations will be started at 12 weeks of age per the American Academy of Feline Practitioner's(AAFP) protocols/recommendations
- Purchaser agrees to never have this kitten/cat vaccinated for FIP, or the health guarantee will be null and void.
- Kittens/cats are guaranteed to be FELV and FIV negative.
- Purchaser becomes the owner of kitten/cat upon Seller’s receipt of Payment in Full. The kitten/cat will be cared for by the Seller until the arranged shipping date or until Buyer is able to take possession of kitten/cat. This period of care is not to exceed fourteen (14) days from date of sale unless kitten is not old enough to depart the cattery (no earlier then 10 weeks of age).
- There are no cash refunds.
- Breed and/or Showing animals: Breeder does not guarantee the size, markings, or colorings of said kitten/cat at maturity, whether purchased for breeding, show exhibition, or as a pet/companion.
- If any legal action is commenced by Purchaser or Seller as a result of this contract, Purchaser agrees that the place of venue for such action shall be the Sellers home state and county. Purchaser assents to personal jurisdiction within such venue regardless of their place of residence, and agrees that any judgment obtained is enforceable within the jurisdiction that they reside in as if obtained within that jurisdiction. A facsimile signature shall be enforceable as an original if the original should be lost or destroyed.
HEALTH GUARANTEE
The kitten/cat is guaranteed to be of sound health upon date of purchase (arrival). It is guaranteed for a period of three (3) days from the time of arrival, if vet-checked within that time, at the Purchaser’s expense. It is recommended that the kitten/cat be quarantined during this time. If it is found to be medically deficient by a veterinarian within three (3) days, it must be reported to Deity immediately. The seller assumes no responsibility after that three (3) day period, as the seller has no control over its treatment, how it’s fed, exposure to germs, etc. We suggest that you take a towel with you to the vets office to cover the examining table, and make sure that neither the vet, nor his assistants handle the kitten/cat without thoroughly washing their hands. Do not allow other animals, children, staff, etc., to touch your kitten while in the waiting room. The seller is not responsible for any vet bills after the kitten leaves the seller’s home. If on the rare occasion that a kitten/cat should have to be returned, it will be replaced with another kitten/cat of equal value; or the full purchase price will be refunded. If no replacement is available at that time, seller will have one (1) year to furnish a satisfactory replacement. The kitten/cat cannot be returned after the guarantee time has expired, and/or if it has been exposed to another cat which has not been currently tested for FELV and FIV. It is the financial responsibility of the purchaser, to provide immediate veterinary care to this kitten/cat if it shows any signs of illness or distress. Failure to do so will render any guarantee null and void. Under no circumstances is a kitten/cat to be destroyed prior to notification by the purchaser to the seller. If a kitten/cat dies within the guaranteed period, despite medical treatment, compensation will be made only if a veterinarian certifies the cause of death as being disease or congenital defect. Trauma, abuse, or neglect will void this guarantee.
This kitten/cat is guaranteed against congenital defects for one year. Should the kitten/cat die within that time as a direct result of a congenital defect, the kitten/cat will be replaced only if an appropriate autopsy is performed by a licensed vet, and a vet’s certificate is provided as proof regarding the cause of death. A replacement will be made with a kitten/cat of comparable quality and value as available, at the discretion of the breeder.
This contract is legally binding to all parties involved. It applies to the purchaser and seller involved in this transaction and is non-transferable to other parties.
